This Privacy Policy describes how Carbonology Interactive LLC (“we,” “our,” or “us”), through the subsidiary Gatsby.af, collects, uses, and otherwise processes personal data that you provide to us, or that we obtain or generate, to provide you with our messagingservices, including our apps, features, software, and website (“Gatsby”).
This policy is intended to help you understand:
We issue unique phone numbers (“Gatsby Numbers”) to individuals and entities or their designees (collectively, “Gatsby Leaders”).
Gatsby Leaders can use Gatsby to message with the individuals who have signed up to receive their messages (“Gatsby Members”).
Please also read our Terms of Service (“Terms”), which describe the terms under which you use Gatsby.
We collect the following when you use Gatsby:
Contact info
To sign up as a Gatsby Member, we require certain information, such as your name, date of birth, gender identity, city, and phone number. You may have the option to provide other information as well, such as your email address. We refer to all of this as “contact info.”
If you start a conversation with a Gatsby Leader by sending a text message to their Gatsby Number, we collect your phone number along with the contents of the text message, so we won’t need to ask you for it. If you later start a conversation with another Gatsby Leader by sending a text message to their Gatsby Number, we won’t need to ask you again for your contact info. If you start a conversation with a Gatsby Leader from a supported website or Internet-based messaging service, the required contact info and signup process may vary.
Note: Gatsby Leaders may be able to save copies of their Gatsby address book for use outside of Gatsby, which may include your contact info.
Account Info
To sign up as a Gatsby Leader, you must set up a Gatsby account. We require your email address, and you may have the option to provide email addresses for additional authorized users for your account. You may customize your account by providing a profile name, profile picture, and voicemail message.
Messaging info
When you send or reply to messages via Gatsby, we collect your messages, along with message-related information (such as the phone number from which the message was sent, when the message was sent, and whether the message includes a particular word, phrase, or emoji). When you interact with messages sent via Gatsby, we collect information about those interactions. We refer to all of this as “messaging info.”
Keep in mind that anyone who receives your messages via Gatsby can save a copy and share your messages with others. This includes any personal information you send in a message (for example, your address), so be careful with what you choose to share.
Note: Gatsby Leaders may be able to save copies of their messaging info for use outside of Gatsby.
Technical info
When becoming a Gatsby Member or a Gatsby Leader, and when using our apps and website as a Gatsby Leader, we collect Internet, electronic activity, and other information automatically from the devices and browsers that you use and from the messages that you send. This includes information about the type of device and operating system you use, your phone number, your IP address, cookie and device identifiers, the type and version of browser you use, app version, and your ISP or wireless carrier. We may also collect information about your location, such as by using your IP address to determine your approximate location. When using our apps and website as a Gatsby Leader, we also collect information about the links you send or click on, pages you view, other information about how you use Gatsby, and other standard server log information.
Payment info
You may provide us with payment information, such as your credit or debit card number, card expiration date, CVV code, and billing address.
Correspondence
When you contact our customer support team, participate in one of our surveys, contests, or promotions, or communicate with us in any other way, we’ll collect whatever information you volunteer or that we need to resolve your question.
Other info
We may also receive information about you from other sources, including from users of Gatsby, and third-party services and organizations.
We may aggregate or de-identify the information described above. Aggregated or de-identified data (meaning data that cannot reasonably be tied to you or used to identify you) is not subject to this Privacy Policy.

If you access third-party services via Gatsby, these third-party services may be able to collect information about you, including information about your activity on Gatsby, in accordance with their own privacy policies.
When you use Gatsby, we use cookies, pixel tags, local storage, and other similar technologies (collectively, “cookies”), including third-party cookies, to collect information from your browsers or devices. By using Gatsby, you consent to our use of cookies and similar technologies.
The following types of cookies are used on Gatsby:
Some mobile and web browsers transmit “do-not-track” signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
If you are a Gatsby Member:
Note: if you unsubscribe from a Gatsby Leader’s messages, they won’t be able to send you additional messages via Gatsby, but we and they may still have your information.
You may be entitled, in accordance with applicable law, to object to or request restriction of processing of your information, and to request access to, rectification, erasure, and portability of your information or more information about our information practices. Requests should be submitted in writing by emailing us at privacy@gatsby.af. We will try to comply with your requests as soon as reasonably practicable or as required by applicable law.
There may be legal requirements to retain your information, for instance if we receive valid legal process asking us to preserve data or if we are investigating potential violations of our Terms.
You may be able to refuse or disable cookies by adjusting your web browser settings. Some browsers have options that allow the visitor to control whether the browser will accept cookies, reject cookies, or notify the visitor each time a cookie is sent. Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section). If you choose to refuse, disable, or delete these technologies, some of the functionality of Gatsby may no longer be available to you.
The California Consumer Privacy Act (“CCPA”) affords consumers residing in California certain rights with respect to their personal information.
Your CCPA rights
If you are a California resident, this section applies to you, and here is a quick summary of your rights under the CCPA:
In the past 12 months, we have collected the categories of personal information described in the “Our collection of information” section above, including: (i) identifiers; (ii) internet and other electronic network activity information; (iii) financial information; (iv) geolocation information; (v) other information you provide; and (vi) inferences from this information.
We collect personal information for the business purposes described in the “Our use of information” section above.
We do not sell your personal information to third parties. In the past 12 months, we have shared your information with third parties for business purposes and with Gatsby Leaders at your direction, each as described in the “Our disclosure of information” section above.
CCPA requests
Depending on your request, we may ask you to take steps to verify your identity, such as by texting us from the phone number you used when signing up or providing additional information. We will not discriminate against you for exercising your rights and choices. If we receive your request from an authorized agent purporting to act on your behalf, we will ask the agent to provide proof that it has valid written authority to submit requests on your behalf, and we may ask you to verify your identity directly with us and to confirm that you provided such agent with power of attorney.

We collect and process information about you only where we have legal bases for doing so under applicable laws in your home country. The legal bases depend on the services you use and how you use them. This means we collect and use your information only where:
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. If we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using Gatsby.
When we share information of customers in the European Economic Area, the UK, or Switzerland, we make use of the European Commission-approved standard contractual data protection clauses (a copy of which can be obtained by emailing us at privacy@gatsby.af), or other appropriate legal mechanisms to safeguard the transfer. Information will be retained only for so long as reasonably necessary for the purposes set out above, in accordance with applicable laws.
Individuals in the EEA, UK or Switzerland have the rights described above in the “Your rights & choices” section, and may exercise those rights by contacting us as provided in the “Your rights & choices” section. You may lodge a complaint with a supervisory authority if you believe our processing of your information is unlawful.
By using Gatsby and providing us with information, you understand and agree that we may transfer and store your information on servers located outside your resident jurisdiction. Where permitted by applicable law, to the extent you are a resident of a country other than the UnitedStates, you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy. Some of the third parties described in this privacy policy, which provide services to us under contract, are based in other countries that may not have equivalent privacy and data protection laws to your home country.
We do not knowingly collect or sell any information from children, as defined by applicable law, without parental consent or as otherwise permitted by applicable law.
We may modify this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the “Last updated” date above and post the new Privacy Policy on gatsby.af.
